Non-profit staff now permitted to provide immigration-related guidance in Reconsideration of IRPA Section 91

For an extended period, IRCC maintained a position on section 91 of the Immigration and Refugee Protection Act (IRPA) that, according to legal experts consulted by the Canadian Council for Refugees, was flawed. This stance suggested that only licensed legal professionals could offer immigration-related guidance or support. However, as of October 2024, IRCC revised its approach and now affirms that non-profit staff and volunteers—regardless of being paid by their organization—are permitted to provide such assistance, provided they are not compensated directly by the individuals they are helping.
